What is an Exclusive?
DEFINITION: "I want to rap/sing over your beat for my album and I want to be the LAST to buy it"

 

Exclusive Rights
​[Full Ownership]

An Exclusive Rights license (exclusive) comes as a mixed, untagged 24-bit/44.1 kHz/512 point sinc WAV file (Highest Quality), the WAV trackouts (separated WAV tracks) and a contract/invoice, stating the rights of use and details of purchase. The Licensor grants the Licensee the right to record vocal and/or instrumental synchronization to any or all parts of the Instrumental. The Licensor has full rights to record, alter, mix the Instrumental in any shape, way, or form (except reselling the Instrumental).
The Licensee is allowed to use the Master Recording for unlimited profitable/commercial uses (e.g. album, EP, single or mixtape or YouTube videos) on any physical or digital medium such as CDs, DVDs, Blu-ray Discs, VHS videos, USB-Sticks and all other forms of media or digital sales (e.g. itunes, google-play, amazon, spotify, etc.) all 100 % royalty-free. The Licensee is entitled to keep 100% of all royalties and publishing that is generated from sales of the Master Recording on digital retailers (such as iTunes), through physical sales (such as Compact Disks) and on online streaming services (such as Spotify). The Licensor must receive credit for the Instrumental, unless agreed upon otherwise by the two parties. Written consent is required if the Instrumental is to be used for Radio Broadcast, Commercial Advertisement, Television Broadcast, Video Games, Internet, On-hold & In House Background Music, or Film Soundtracks. Licensee may also use the beat(s) (or song) for non-profit promotional use or demos (mixtapes).

Credits: ALL songs including our production MUST be credited as "Prod. By Elomuse" upon release to the public.

License Definition: Instrumentals purchased from Elomuse.com as Basic, Premium, Premium Trackouts, or Unlimited licenses are LICENSED, NOT SOLD, to you for use only under the terms of the applicable license agreement. These licenses grant non-exclusive rights only. Only the Exclusive license includes exclusive rights. Elomuse.com reserves all rights not expressly granted to You.

 

Legal Notice
Any unauthorized use of the beats, including commercial use of tagged beats as well as unauthorized reselling, is considered a direct violation of the Copyright law and is infringing upon the copyrights of the works of Elomuse. Under the fullest extent of the law, Elomuse reserves the right to take legal action or pursue financial compensation as a result of any breach or violation of the Licensing Policy.
 

 

How can I buy your beats?
​You can buy our beats by clicking the beat names in our Beat Store on our Home page. Browse through the beats and click on ‘Add’ if you want to purchase a beat. Select the License you need and go on adding all other beats you want to purchase. After that, click on ‘Buy Now’ and you will be redirected to PayPal, where you will be able to pay using your PayPal Account or using your Credit Card. You will receive your downloads directly after the payment.

What do the different licenses mean?
Simple! The leasing licenses work all the same. (Basic Lease, Premium Lease & Premium Trackouts). Leasing & Premium means, that you are allowed to record your song and sell/distribute it a limited number of times until you need to buy a new Leasing license. Exclusive means, that we will transfer the whole ownership to you. In that case, the beat isn’t eligible for purchase once the agreed fee has been paid and both parties have signed the contract. Are beats removed from the website once bought?
Yes. When an exclusive beat is bought, it will no longer be available for sale or download." When a non-exclusive beat is bought, it will remain on the website and can still be bought by others. The next question and answer will explain how the same beat can be bought by multiple people.

When you purchase a beat from Elomuse, the copyright for that beat alone still belongs to Elomuse. However, the copyright for the song that you make with that beat, your lyrics combined with that beat, belongs to you. And with the rights granted to you by the Elomuse license agreement, you are allowed to sell, distribute, perform and broadcast (TV, radio, Internet) that song, keeping all of the royalties.

What if two different people buy the same beat?
If two different people buy the same beat, they can still each copyright their own song they make with that beat, and sell, distribute, perform and broadcast that song, keeping all their own royalties.


Do You Make Custom Beats?
Yes, we also make custom beats! Prices start at $250.00 USD and depend on the length and complexity of the track. We also accept payment plans (50 % prepayments and 50 % upon completion)

What payment methods do you offer?
We only accept PayPal payments. However, a PayPal Account is not needed when paying via Credit or Debit Card. If you’d like to pay in a different way or looking for a payment plan, please contact us and we will let you know if this is possible.


I want to use a beat for my video(s) on Youtube. What do I have to do?
You can use our beats for your Youtube video(s) (background music) as long as you link our website (http://www.elomuse.com/


I have bought Exclusive Rights to a beat. Can it be leased again or has it been leased before?
Once Exclusive Rights to a beat have been sold, the beat may not be sold/leased anymore. However, it might be possible that a beat has been leased to several persons before it is sold exclusively.

Exclusive Rights to a beat I leased previously have been sold. Do I need to worry about?
No, as long as the distribution number described in your licensing contract is not reached, you won’t need to worry at all. If this point of sale is reached and/or further sales are desired, further rights with a new sales cap can to be obtained with a new license or license upgrade. License owners of any type of non-exclusive rights may upgrade their current license to the highest available non-exclusive license such as Premium Trackouts.


What are tracked out audio files?
Tracked out audio files, also called stems, are sub mixes of an instrumental. For example, an instrumental might have the four stems: Bass, Beat, Percussion, and Instruments. The Bass stem being the bass; the Beat stem being the kick and the snare; The Percussion stem being the hi-hats, shakers, and crash cymbals; and the Instruments stem being the strings, organs, and synths. All of these stems are the full duration of the instrumental and can be layered together to recreate the stereo mix of the original instrumental.

The reason for stems is that they allow for more precise fine tuning while mixing a song. For example, one can adjust the gain on the Bass without affecting the low end of the Cellos. Or you can mold the cymbals around the vocals without affecting the punch of the snare. Although Elomuse beats and instrumentals come already professionally mixed, depending on the particular artist's vocals or the sound of the rest of their album, adjustments may want to be made in mastering. With stems these adjustments can be made much more accurately and easily.

Can I change up the beat after I buy it?
Yes, you can chop, loop, speed up, slow down, add extra sounds, and change up the beat as much as you want as long as you still give full production credit to the original Elomuse producer.

How do I give credit to the Producer?
In all projects where any part of a Elomuse beat is used, be sure to give credit in one of the following formats:

"Produced by (Elomuse)"
"Beat by (Elomuse)"
"Original Music by (Elomuse)"


Do you use samples?
No. All Elomuse beats are made using copyright-free or licensed sounds, so you don't have to worry about clearing any samples. However, we have sampled beats with free downloads for NON-PROFIT USE ONLY

Can I sell my beats on your site?
Definitely, at the moment we are looking for additional producers. We will probably hold a tryout and choose from the best, so stay in touch and keep making beats. Contact us for more info.
